
Arizona Attorney General Kris Mayes' "fake electors" case, which prosecuted 11 Republicans who submitted votes falsely asserting that former President Trump won Arizona in 2020, must return to the grand jury stage, a Maricopa County judge ruled last Friday.
This is a major blow to the Democratic AG's attempt to prove that the electors sought to undermine the democratic process in 2020 and gives weight to the electors' argument that Mayes' case was shoddy and politically motivated.
Maricopa County Superior Court Judge Sam Myers ruled that Mayes must re-present the case to a grand jury because her team never provided jurors with the text of the Electoral Count Act of 1887 — the law electors believe proves their innocence.
The judge wrote that the defendants were "denied a substantial procedural right" because the AG's office did not provide adequate information to the grand jury.
A grand jury will now reconsider the indictments. The timeline for this is not yet known.
Ellis and Pellegrino have already accepted plea deals, which Taylor said remain valid despite Friday's ruling.
