This would be bad even if convictions were 100% accurate.
But they aren’t—people are wrongfully convicted (or pressured into taking plea deals) every year. And while you can overturn a prison sentence or a fine, you can’t reverse genital mutilation or the death penalty.

It’s cruel because it willfully causes extreme pain or suffering onto others.
It’s unusual because no other states (or the federal government) do it.
