The BC Conservative party constitution apparently states that a leader can only be removed by death, incapacitation, resignation or removal by leadership review (by the larger party membership, which he recently passed with 70% support). The party’s board of directors has gotten around this by declaring him “professionally incapacitated” – in that he no longer has the support of the caucus or the board – and the caucus have in the hours since already elected a new interim leader.
Rustad has gone to the provincial Speaker’s office and apparently also lawyers to find support to fight back. Though, clearly it would be in his best interest to resign anyways if he doesn’t even have the majority support of sitting members in legislature. That, or the party falls apart as he tries to fight this through the legal system.

This situation is very bizarre because it’s not clear whether or not John Rustad can be removed as leader. He’s refuses to step down and still claims to be leading the BC Conservatives.
There’s a bit of a power struggle between Rustad and the board of the BC Conservatives happening right now and I’m really curious to see who gets out ahead. One would think Rustad is finally turfed, but who knows. There might be an upcoming legal battle here.
