Let alone fail, even when a diesel runs low on def it goes into limp mode. Ranging from wildly inconvenient, to potentially dangerous. I wouldn’t want that to happen pulling up a hill. Bad enough it happened on flat-ish ground.
As for tuning. The emissions it took to write the law against likely matched the emissions they were “fighting”. While yes you can tune to run dirty. Most will have multiple profiles, one dirty for the occasional fun having… And the rest of the time a higher efficiency profile. Few people want to just run rich straight time.
