Lindsay Clancy’s lawyer drops jury bombshell — reveals one juror ‘refuses to listen to the law’

    So, this isn’t actually that much of a bombshell. 

    He’s making that objection based on jury behavior in the courtroom. He believes that the entire panel supports a not guilty (for reason of insanity) verdict except for that one hold out, or that the removal of that juror may break the deadlock in his client’s favor.

    He may or may not be right about this. Either way, he has no more information about the jury deliberations than we do and is simply guessing.

    As the jury is deadlocked and he made the request out of its earshot, there’s not a lot of risk to making the motion. He’s rolling the dice and seeing if it’ll work out for his client.

    The judge denied the motion, so the juror is still on the panel.

  2. The lawyer doesn’t know what’s happening in there. I was on a jury for a homicide trial and we never spoke to or interacted with either council in any way.

    That said, we also had one guy hold out for a while because he didn’t understand what “reasonable” means. Another Juror and myself basically had to relitigate the entire fuckin’ case for this guy to explain why walking up to a car stopped at a traffic light and shooting the driver in the neck isn’t self defense.

    Reasonable doubt is kinda in the eye of the juror isn’t it? If they are convinced the state proves she guilty beyond a RD then they can stand on it and the other 11 can kick rocks.

    I will say in my one federal trial the jury instructions were the hardest part in deliberations. I no 💩 sat there reading them aloud multiple times to get people to understand.
