Holdout Won’t Budge in Clancy Trial; Judge Calls Mistrial, Defense Asks High Court to Dump Juror

The word I’m hearing is that the one hour the judge gave to the defense attorney to get the MA Supreme Court to replace the holdout juror has expired without success.
This is just going to make the husband have to suffer through the trauma of seeing his dead kids again. Her dead eyed stare the entire trial and her statement being “I need a lawyer” being the first thing she communicated about when she came too tells you how evil of a human being she actually is.
I saw an article on the New York Post that seemed to imply the possibility that the DA overreached:
“Reddington previously indicated if the case were retried, Plymouth District Attorney Tim Cruz would opt to downgrade the charged to second-degree murder.
The hypothetical scenario would allow Clancy to choose a judge rather than a jury to oversee her retrial, an option not afforded to her with first degree murder charges.”
I can’t help but wonder if the State went for Murder 2 out of the gate, if some of this clown-show would have been avoided?
I suppose then it opens up the possibility of a far too lenient judge but there’s something more palatable about the social implications being out of the hands of a jury of peers.
