Should I cancel my NYT subscription? On one hand they keep doing shit like this but they still have Ezra Klein and a pretty good selection of podcasts.
I find it so weird that American constitutional law uses the transcripts of the discussions of laws and amendments to the constitution to try to understand whether X or Y is legal or not.
In my country, the judges just read the constitution and see what they think it’s saying.
if you want to trigger an orginalist say the Second Amendment only covers flintlock rifles. For some reason they are selective about what they said should be kept. Also they just ignore the Preamble which in my opinion is more important then the Amendments
