
The gist of the argument is that while the president does have to power to determine standards of military readiness, previous administrations have used that power to discriminate against marginalized groups. We’ll see how it pans out I guess but we can enjoy a little good news for once.

Fuckin thank you. Absolute soul sucking dishonor that a judge has to tell the SecDef that the US Military is stronger, not weaker, for the differences and individuality of the people that serve within it.
Don’t Ask, Don’t Tell threatens to come back against the most recent Republican hated minority du jour and at the very least there is a single person with some level of authority that has done something. Thank you Biden, for appointing this judge.

Is there any legal reasoning here or is it just that discrimination is wrong?
What I mean is, if they wanted to ban gays, women, non-whites, etc.. would there be any recourse other than a court saying nuh-uh?
