TL;DR: federal law currently allows ICE agents to detain suspected aliens with only an “administrative warrant”, signed by fellow ICE admin staff, as long as the suspect is in a public place. This also allows ICE agents to make additional arrests of other bystanders based on probable cause, a tactic known as “collateral.”
In some cases ICE has arrested individuals with no warrant whatsoever, producing documents that were signed hours after the arrest already occurred.
If I ever meet ICE officers at a rally I will be recruiting US citizens to get arrested with me. I will pay any fines or bail to get them out. I would advise people to leave their phone, wallet, and keys with friends so that ICE can’t confiscate and “lose” anything. I will just claim I don’t know where I am from, and that I don’t know my citizenship status, but believe myself to be illegal while avoiding saying anything that would be a lie.
Hopefully, walking up to them and trying to convince them I am an illegal will be enough. Every hour I waste of theirs in custody is an hour or spot in a cell they can’t use to violate others’ civil rights. Also, hopefully, a dozen people or so will be less than 10k out of my pocket. I am really curious as to what (if any) legal representation I can get and how the process goes.
Of course, the best case scenario would be if I actually get deported. That would be hilarious, as long as I don’t end up in the El Salvador gulag. As long as I have access to a phone, I have the money and resources to get back, and the story I would have for any journalists will be epic. I hate playing identity politics, but I am a combat vet who deployed to Afghanistan. I never lived outside the US other than with the military. I am the most typical early millennial white dude possible. I really really hope I get deported.
