    They are going to try for some middle ground where they say the statute doesn’t authorize tariffs but Trump’s tariffs in particular are entwined too closely with bilateral “deals” which are too central to the executive’s foreign policy authority for the courts to unwind

    Is anyone expecting anything other than them allowing them? It’s less of a trolley problem and more of a creative writing exercise for them.

    I don’t think ending Trump’s tariff authority would cause as much chaos as the author speculates there would be.

    If Republicans want to pass a national sales tax, then let them use the congress to do so.
