    The part of the standard for a preliminary injunction is the likelihood of prevailing on the merits of the case.

    This is administrative rule, meaning not passed by Congress specifically. Unless the plaintiff argues that they are in specific contradiction to the law passed by Congress then the plaintiff has a near zero chance of prevailing.

    This is almost certainly a loss on appeal. And really speaks to how messed up the DC Circuit is right now.

    While there are bigger fish to fry, I do think we might want to consider doing what Obama did and expand the number of judges and take the next 10 or more conservative judges to counter act this terrible group.
