Assuming this is an official statement, are my 4A rights null?

    No. But you may not interfere in law enforcement operations.

    If you feel your rights have been violated or you witness it happening to someone else, record if you can, shut the fuck up and call a lawyer. Make sure you actually know your rights including local ordinances. You know what doesn’t scare power tripping cops? The maniac screaming “I know my rights!”. You know what does? The calm, quiet guy.

  2. I remember that when people said the Trump Admin was Authoritarian it was fear mongering, here and so many other places.

    When people in government say something, never downplay it as a joke, or assume it cannot happen.

  3. Yet, the right and republican-lites refuse to acknowledge how Trump is an authoritarian they claimed to be against. Pretty sure they are pretty much saying, you’re no longer allowed to use your 1st in order to speak against tyranny. When you no longer can use your 1st, you must use your 2nd.

  4. The post doesn’t say anything about searches, only that ICE officers have federal immunity in the conduct of their duties, which is true. The context of the post makes clear that this federal immunity applies to people who would try to obstruct ICE, saying that none of them have the authority to stop you as an ICE agent. Which is true, they don’t.

    ICE still needs to follow the 4th amendment, and nothing in this post says otherwise. So no, your 4A rights are not null.

  5. No, this does not supersede the 4th amendment. Everyone needs to just relax. This has always been the case. It’s called obstruction if you interfere. This isn’t anything new,

  7. In another way, how long until police officers no longer need to read you your Miranda rights? To say an officer has immunity undermines the entire judicial system, let alone our rights.

  8. So here’s the thing. This is nothing new. It’s. It libertarian so you shouldn’t be happy about. But it’s a trick.

    The trick is, an ICE officer just shot a woman in the face because he was poorly trained, or stupid, or a maniac. Or all of the above.

    Steven Miller is correct in what he says. But it implies that an officer of the state can murder you for it. Which is not correct.

    It frames the whole thing like people are upset or uncomfortable with it because they think the lady should have had no consequences for obstructing his mission. It gets people debating that instead of the murder.

    Obviously libertarians are against the state’s monopoly on violence anyway. But the point is this isn’t what THIS is about. So don’t let them distract you.

    I meant, it ISNT libertarian so obviously we are not happy with the contents of his post. But he’s only reiterating laws that already exists. But since he’s doing it in the context of the recent shooting, it makes it seem like he’s saying the law has always protected what ICE did. But it doesn’t. And I feel like his post is going to get people in the weeds of qualified immunity and stuff, instead of focusing on how bad of a job ICE did there and has been doing.

  9. “legal obligations and duties” should, in theory, exclude something like just busting down your front door without a warrant. Of course, they’ve already been doing that with impunity because the ICE is even dumber and more sociopathic than average law enforcement, the president is a narcissistic fuckwit surrounded by sycophants, and his party has abandoned all principles.

    edit: Just because DHS tweets something that a non-lawyer says, doesn’t mean it has any legal validity.

    He is speaking directly about State officials, protestors, illegal immigrants. Federal supremacy law trumps State officials wanting to interfere with a federal immigration officer carry out his lawful duties.

  11. You can protest all you like. You can say whatever you want. What you can’t do, without possible repercussions is get in the way of an arrest in progress from a Federal Agent. That’s not your job, nor it is an expression of your 4A rights – as you (I’m assuming?) are a U.S. citizen? Illegal aliens have protections of 4A – but they are restricted. They can’t be within 100-miles of a Border OR of an airport (yeah that’s weird too). Otherwise the Feds can do whatever they are charged to do, in this case, ICE has been ordered to arrest and process the illegals via whatever they have set up. Not sure what this has to do with you specifically, unless you’re an illegal alien.

    So there you go. Good luck in either case.

  12. It really seems like Trump and DHS is trying to get an agent killed so they can use it as an excuse for further crackdowns and possibly to try mobilizing the National Guard all over again.

    I love how some people on here support small government until it does something they agree with. Then they’re like “yeah, let’s give ICE 170 billion dollar, send 2k poorly trained agents to Minneapolis to terrorize the city, and then have the National Guard sent to protect them (which will happen, mark my words).” Real small time government supporter you are.

    It says that if ICE is in the process of arrest, and you come and try to kick the agent in the balls, you’ll get your ass handed to you, straight forward police procedure really.

  15. You do realize that they are not stating anything that wasn’t already a given correct? Like seriously. Do you guys understand that federal agents and even state and local law enforcement have the legal power to do their job? Do you not comprehend that?

  16. The wording “to perform your duties” is very ambiguous. Also, DHS doesn’t actually have the authority to make laws, as much as they’d like to.

    The verbiage seems a bit off and like it’s crafted rage bait.

As a Swedish libertarian (which is very different from an American one, and we will disagree on many things), it seems to me that the Democrats believe in freedom, but think that “good government” (or rather their version of it) is what will lead to said freedom. This leads to bloat, waste and corruption as their method is very flawed, but at least most of them believe that they are doing what is right.

    Meanwhile, the current Republicans believe that freedom is for “their team” to be allowed to do whatever they want with impunity, because in the zero-sum world they inhabit, taking freedoms away from others must result in more freedom for them – not realising they’re one dissenting view away from being the “other”. Meanwhile, the republican politicians believe in nothing except “get mine while the getting’s good”, the administration believes in “might makes right”, and your President believes he is God-King. Seriously, he is clearly no longer well. That interview he did with the NYT was insane, he literally said he was only constrained by his own morality – he recognises no laws, no Congress, no Supreme Court, no limits beyond his own will.

    I have never seen a country willingly abdicate its freedoms this fast in my lifetime. Maybe Iran in 1979, but that had no guardrails. America is supposed to have checks and balances, what the f–k is going on?.

  19. It’s important to remember that the constitution overrules all statements made by the government. Especially within the bill of rights. No matter what, exercise and protect your rights that are supposed to be granted by the constitution. Stay alive out there.
