This is a very interesting article about some of the issues regarding commercial surrogacy. Interestingly, this is one policy area where there is strong divide between the US and the rest of the West. I would be interested in knowing if you all think commerical surrogacy should be legal or not.
It should be well regulated but its more ethical than organ sale imo.
The downsides are mostly from poor legal structuring and a lack of a comprehensive contract law for surrogacy.
If you make the law clear and everyone involved is willing I see no problem with it.

In a freer world, we should expect that family shapes look far different than the defaults were used to. The question really is just of ethics in those practices.
Surrogacy has some… hard questions at the root of it. Sure of exploitation, but also of the perspective and long-term identity of the child, who will grow up to have their own perspectives, in question.
The article is behind a paywall, so I cannot read all of it, but I’ll note it started with a couple paragraphs on a surrogate mother. I’d be curious if they were perspectives of the children, or especially adults who were conceived via surrogacy, included here.
I know there’s an increasing movement amongst adults who were adopted or raised via donor surrogacy to have their perspectives heard. And in particular to have far deeper regulatory practices involved, especially ending commercial practices of it.
Those perspectives are not always so gentle when it comes to the choices the adults in their lives made back in the day. And many end up seeking and reuniting with their biological families as they get older.
Surrogacy is not a free (or paid) ticket to the family of the parents choosing. It’s a lot more complicated than that.

To me, this is human trafficking. Regardless of any safeguards to the mother, the baby is just a product.
It should not be possible to shift custody from the birth mother without a judge and/or regulated adoption agency being involved and subjecting the prospective parents to a full homestudy and etc.
