The ICC is worthless anyway. No one truly respects it, it has no enforcement power, and can’t impose real sentences on anyone unless member nations agree somehow to cooperate on it. It has no power over national sovereignty.
It’s the same scenario as the UN.
It’s a club. An organization based purely on agreement and handshakes and hoping everyone cooperates, otherwise it all falls apart into irrelevance.
