    I have long predicted we would come to some sort of constitutional crisis over this as the Supreme Court expands its authority, and while I don’t think it’s quite imminent I think surely this is no longer some out-there scenario. Especially now as it seems to be locking into a partisan pattern where progressives are furiously opposed to s33’s existence and conservatives decry any attempt, even something as superficial as this initiative, to constrain or qualify its use.

    Unfortunately I must side with the conservatives in this struggle (not particularly in this case, which I think is a very reasonable move from the Carney government to tease out the Court’s position and attempt to forestall gross misuse of the clause). I will always back an elected legislature over an appointed court.
